Docu-File Title and Escrow & Florida Title Pros Complaint: The Problem

The condo sale closed on April 20, 2012.  Patti Dulaney, the closing agent, neglected to collect from the seller:

  • $250 security deposit
  • $600 prepaid advance last month’s rent
  • $200 in prorated April month rent

totaling $1050.

The contract provides the escrow closing agent’s instructions, and specifies that the closing agent is responsible for collecting these monies from the seller and paying them to the buyer.  The escrow instructions contained in the contract state that these monies are to be handled and disbursed by Florida Title Pros of Brandon (an affiliate of Docu-File Title and Escrow of Tulsa).  The contract references are:

  • Section 6 Occupancy and Possession
  • Section 13 Escrow Agent
  • Section 18 Standards, Section (ii) Title Examination,  Parts D (Leases) and K (Prorations and Credits)
